That Transportation Committee recommend Council approve the waiver of Section 3(2) of the Encroachment By-law 2003-446 to permit a raised platform to remain as a permanent surface encroachment on the Guigues Avenue road allowance at 224 Dalhousie Street.

d’empiètement sur les voies publiques, afin de permettre le maintien d’une
plate-forme surélevée comme empiètement en surface permanent sur l’emprise
routière de l’avenue Guigues au 224, rue Dalhousie.
BACKGROUND
The site is a mixed-use property on the northwest corner of Dalhousie Street and Guigues Avenue (Document 1). A raised platform has been constructed on the Guigues Avenue road allowance, where surface encroachments on the road allowance are strictly prohibited by Section 3(2) of City of Ottawa Encroachment By-law 2003-447. The applicant has petitioned the Ward Councillor for waiver of the by-law in order to permit the encroachment to remain permanently on the road allowance.
DISCUSSION
The City's Encroachment By-law provides for property owners to construct items on the road allowance only under limited circumstances, and only as aerial or subsurface encroachments. The By-law strictly prohibits surface encroachments, in order to preserve the road allowance for public and priority uses. Priority uses include access to utility corridors, snow storage related to snow removal operations on public roads and sidewalks, and the safe passage of pedestrian and drop-off traffic.
Alternative surface treatments on the road allowance
may be tolerated if approved through Site Plan Control, with the condition that
the applicant enter into a Maintenance and Liability Agreement with the City,
agreeing to accept all future costs and liabilities associated with the
embellished road allowance. Alternative
surface treatments may include hard landscaping such as pavers, asphalt, or
interlocking brick constructed at the same grade as the public sidewalk, or
soft landscaping such as trees and shrubs.
On 2 October 2006, the City's Planning and
Infrastructure Approvals Branch approved Site Plan Control Application
D07-12-05-0284 at this location, with two alternative proposals for landscaping
on the Guigues Avenue road allowance - one with pavers at surface level and the
other with grass and shrubs (Document 2).
The approval included a condition that the owner enter into a
Maintenance and Liability Agreement for all plants and pavers in the
right-of-way.
Neither of the proposed treatments were
constructed. Instead, two permanent,
raised platforms were constructed on the road allowance at this location
(Document 3). When staff became aware
of the irregularity, and since no exceptional requirement for a permanent
raised structure had been demonstrated, the owner was notified that the platforms
must be removed.
At this time, the applicant has requested that the
raised platforms be permitted to remain on the road allowance by waiver of
Section 3(2) of the Encroachment By-law.
Should the waiver be approved, the raised platform will become the
subject of a Permanent Encroachment Agreement to be registered on title of the
property, ensuring that the owner is responsible for any and all maintenance
and liability related to the encroachment.
The Ward Councillor supports this waiver. Surface Operations Branch has requested that, should the platforms remain, they must be removed from the first 0.3m adjacent to the public sidewalk and the railing remain in place at all times, to provide for the safe operation of sidewalk plows (Document 4).
LEGAL/RISK MANAGEMENT
IMPLICATIONS
No legal and risk management implications, provided the Applicant signs
the standard encroachment agreement, the standard conditions of which include
provisions that the term of the Agreement will be for the life of the
encroachment or the abutting building, or until redevelopment of the abutting
site, and that despite the term of the Agreement, where necessary for municipal
purposes, the Agreement may be terminated on 30 days notice.
FINANCIAL IMPLICATIONS
The applicant will be responsible for any costs related to the encroachment, including maintenance, liability, or removal, and also bear all costs for entering into the Permanent Encroachment Agreement.

Upon approval of the recommendation contained in this report, Public Works staff will inform the applicant of Council’s decision and initiate the Permanent Encroachment Agreement.
